ABOUT MAJOR
ACCIDENTS
As
travel and commuting in our country have increased, the
incidence of major accidents has increased. We read daily
about train wrecks, multi car accidents, bus accidents,
aviation disasters, massive pile-ups on our freeways and
major transportation arteries. These major accidents
often involve large numbers of passenger cars and trucks.
The physical pain and injuries, the property loss as
vehicles are damaged, the costly repair or replacement and
the loss of income are distressing. For many individuals,
these unfortunate occurrences are a part of their future as
they struggle with disabilities, pain and loss of
transportation.
Accidents and
collisions are often caused by overused highways;
dangerous intersections; badly lit, poorly designed and
maintained roads and crossing traffic lanes; vehicles making
improper turns; impaired, unlicensed or drunken drivers;
obscured vision due to weather conditions or improper
highway design; faulty automobile equipment such as tires or
airbags; worn or damaged roadway markings or other unsafe
driving conditions.
Further trauma is
caused by the disruption of communication in this chaotic
situation. Many individuals experience anxiety at home
as they observe the stressful news coverage of these major
accidents. Waiting relatives and friends are often
uncertain - sometimes for hours - if the delayed homecoming
is due to the subsequent traffic tie-up, property damage,
injuries, severe injuries or even death.
Vehicle
accidents are generally covered under a complex umbrella
of interrelating laws designed to prevent harm or to
compensate a person or group for harm to a person or
property. Major accidents are generally, but not
always, vehicular. There are incidents of bleachers
collapsing at sporting events and balconies separating from
buildings during parties. These are sometimes due to
shoddy workmanship, defective components or neglect in
maintenance.
These incidents are called personal injuries and they are
classified as Tort Laws. Torts occur through
unreasonable negligence, malicious intention or strict
liability.
Medical bills such
as doctor, hospital or physical therapy bills can be
enormous. Accidents involving licensed, motorized vehicles
-- including cars, trucks, motorcycles, mopeds, snowmobiles,
planes, boats, etc., may entitle victims of these accidents
to legal compensation for loss of income and the pain and
suffering endured as a result.

TRAFFIC
ACCIDENTS / WRECKS
Every year there are more then 5 million motor vehicle
accidents. Every day of every year 115 people die on our
roads, that’s over 40,000 yearly or almost the same number
who died in the Vietnam War. In addition almost 3,500,000
are injured and the economic cost directly resulting from
these car accidents amounts to over $150,000,000,000 yearly.
While most car accidents and "fender benders" are caused
unintentionally by mere negligence and momentary lack of
attention, some are caused by seriously wanton and reckless
behavior, such as high speed reckless driving or drunk
driving, or "driving under the influence." Such reckless
conduct is not only negligent, but criminal.
Vehicle Collisions can be "fender benders" or massive
multi-vehicle pile-ups. They can involve cars, pedistrians,
tractor trailers, hazardous materials and can result in
serious injury, or death.
TRACTOR
TRAILER COLLISIONS MAJOR ACCIDENTS / TRUCK WRECKS
5,300
people were killed and 141,000 people were injured in 1997,
as the direct result of
truck wrecks.
The National Highway Traffic Safety Administration (NHTSA)
sponsored a study that concluded approximately twice as many
car drivers would die in collisions with trucks than in
similar collisions involving cars. Occupants of passenger
cars and trucks have much higher fatality rates than in
other accidents.
More and more tractor-trailer rigs, and large trucks, are on
the roads today and driving at dangerously high speeds. This
is putting other drivers at a very high risk of being in an
accident. Trucks that haul hazardous materials, called
“haz-mats,” can turn a fender-bender into a deadly scene.
Speed is not the only thing that causes accidents. Drivers
are being put behind the wheel of their trucks without
proper experience and training. Others are fatigued, because
they are pushed to drive more hours than allowed by law, in
order to meet tight delivery schedules. Still other drivers
are put into overloaded trucks or dangerous double- and
triple-trailer rigs, or trucks with bad brakes. These and
other factors have led to a sharp increase in accidents
involving trucks.
TRAIN
ACCIDENTS / WRECKS
There are over 600 railroads and 200,000 miles of track in the
United States. In 2002, the Federal Railroad Administration
(FRA) reported 11,991 train-related incidents, 950 of which
involved fatalities. Most of these accidents were attributed
to violations in inspections and maintenance. Railroad
companies are considered common carriers and as such they
are held to strict liability standards by the Federal
government. A common carrier is generally required to
exercise the utmost care, diligence and vigilance in
transporting passengers. While individual state laws apply
to train-related accidents, the general rule is that a
common carrier is liable for personal injuries that were
avoidable had the carrier used proper care.
AVIATION
DISASTERS / ACCIDENTS
In 1998, an average of 86% of the occupants involved in an air
disaster perished, which is higher than the 1970-1997
average. As for the circumstances of the accidents, one
accident out of four this year was due to Controlled Flight
Into Terrain (CFIT), and the other causes range through
engine failures, loss of control, overshoot/overrun the
runway, etc. As the number of flights and passengers
continue to increase, so does the possibility for accident
